Terms and Conditions for facilitation of non-financial transaction/s via WhatsApp services (“NFWS”). The availment of NFWS shall be subject to the following Terms and Conditions:
- The User agrees and acknowledges that WhatsApp Messenger (“WhatsApp”), is a third-party application that is internationally available freeware, cross-platform centralized instant messaging (IM) and voice-over-IP (VoIP) service owned by Meta Platforms that allows users to send text messages and voice messages, make voice and video calls, and share images, documents, user locations, and other content; and that Whatsapp requires a cellular mobile telephone-number for sign-up to either run on mobile devices (client-application) and/or be accessible from desktop-computers.
- User/s shall mean any person/s such as (i) individual/s, (ii) partnership/s, (iii) corporation/s (including business trust/s), (iv) limited liability partnership firm/s, (v) body corporate/s, (vi) joint stock company/ies, (vii) trust/s, (viii) hindu undivided family/ies, (ix) unincorporated association/s, (x) joint venture/s or other entity/ies, (xi) government (or any political subdivision or agency thereof), including all such individual/s, algorithms and/or application programming interface/s who is/are authorised to act on behalf of such person/s, and who avail of and/or access NFWS and/or any person/s to whom these Terms and Conditions apply.
- The User agrees and understands that IndusInd Bank Limited (“Bank”) will accept, at its sole discretion, requests from User via Whatsapp only for non-financial banking transactions in relation to the accounts held with the Bank (“Account/s”), wherein only the request/s for such non-financial banking transactions shall be sent via Whatsapp but the processing and/or confirmation of having processed the non-financial banking transaction/s shall be linked to and/or sent to the email and/or mobile number of User registered with the Bank (“Registered Contact”). The requests for non-financial banking transactions shall include balance enquiry, status of lien marking in fixed deposits, current accounts, any outstanding indebtedness, statement request etc.
- The User agrees and understands that WhatsApp being a third-party application is subject to Whatsapp’s terms and conditions governing its usage. The User agrees that the Bank is neither responsible nor liable for the contents and/or functioning of Whatsapp’s application, website, webpage/s and/or server/s or any data-breach, grievance-redressal or reporting of frauds and/or other offences, and that Bank will have no liability if any such incidents are reported via Whatsapp.
- User hereby expressly agrees, accepts and permits the Bank to:
- collect, store, communicate and process data and/or information relating to the Account/s and/or User by any means, necessary for the Bank to maintain appropriate transaction records and to facilitate NFWS through third parties;
- disclose information to third parties or regulatory authorities, Reserve Bank of India (“RBI”), Securities and Exchange Board of India (“SEBI”) or the Enforcement Directorate or Income Tax Authorities about the data and/or information where it is deemed, at the sole discretion of the Bank, as necessary;
- comply with all applicable laws and/or government agencies and/or court orders or legal proceedings and/or when necessary to resolve errors or questions that the Customer or any other party may have raised and/or in order to satisfy the Bank's internal data processing requirements;
- disclose at any time and for any purpose, any information whatsoever relating to the User and/or the Account/s or transactions or dealings with the Bank, to any branches, subsidiaries, service providers, affiliates, group companies, third parties whosoever so far as is deemed to be necessary in the exclusive discretion of the Bank, or associated or affiliated corporations of the Bank wherever located or to any government or regulatory agencies or authorities in India or elsewhere or any agents or contractors or third parties which have entered into an agreement to perform any service(s) for the Bank's benefit, or where the disclosure and/or suitable action is required by law or otherwise and to whom the Bank deems fit in its exclusive discretion to make such disclosure;
- Bank shall not be required to authenticate the User, if any requests are sent to Bank (as a part of NFWS) over the Registered Contacts, and Bank shall be entitled to presume that any request originating from the Registered Contacts is that of the User only.
- User agrees and confirms that for availing of the NFWS service, the User shall apply for registration as prescribed by the Bank and that the User further agrees and confirms that for keeping the NFWS services active , User shall at all times be responsible for getting re-registered by such authentication method as may be required by the Bank [including by way of authentication via One-Time-Password (OTP) method] upon completion of 60 days from the date of the last registration / re-registration undertaken by the User.
- User may choose/request for de-registration/un-subscription of the NFWS at any point of time by following the process and the medium as may be prescribed by the Bank from time to time. [At present the Bank permits requests for de-registration/un-subscription via Whatsapp]
- User agrees that the Bank reserves the right to alter, change, amend, update and/or modify: (i) these terms & conditions (ii) any features of the products and/or services offered by the Bank in respect of which NFWS is being offered and/or any information related to NFWS on the Site; provided that the User, in order to use NFWS, agrees to be responsible to read such alteration, change, amendment, updation and/or modification from time to time.
- Bank may, at its sole discretion, withdraw temporarily or terminate all or any of these NFWS, either wholly or in part, at any time without giving prior notice to the User. Bank may, without prior notice, suspend or all or any of these NFWS at any time during which any maintenance work or repair is required to be carried out or in case of any emergency or for security reasons or any other reason which require the suspension of the NFWS.
- By accepting these Terms and Conditions, the User shall be deemed to have agreed, accepted and consented to: (a) Terms and Conditions applicable to User for availing NFWS mentioned herein (b) Privacy Policy of Bank https://www.indusind.bank.in/in/en/personal/privacy-policy.html (c) WhatsApp Terms and Conditions (d) regulations, rules, gazette notification and/or any other laws applicable hereof.
- User agrees that, irrespective of its location or country of jurisdiction, these Terms and Conditions and its contents shall be subject to and governed by applicable Indian laws (as amended from time to time) and that the User waives all its rights that it may have in relation to these Terms and Conditions under any contract or relevant laws applicable to the jurisdiction where the User is situated and/or by which User is governed and/or where the registered office of the User is located.
- By mention of the term “Whatsapp” herein and/or in any NFWS to be offered to the User, the User agrees and acknowledges that the said mention is merely for convenience of the User when availing NFWS (Whatsapp being a medium of communication) and that there is no intent on the part of the Bank whatsoever to violate any intellectual property right of any person / entity, and the said mention shall not be deemed to be construed as any form of advertising, display, approval or endorsement of any brand and/or content of any person/entity by the Bank.
- User can raise the service request for Account Statement through WhatsApp service for the period upto 3 years from the date of request. For data requirement for the period older than 3 years, user will be required to contact the customer care team by sending the mail to corporatecare@indusind.com.
